1. Scope of application
1.1 The following General Terms and Conditions apply exclusively to the business relationship between the customer and NB Fashion GmbH (Love Joy Victory).
1.2 The General Terms and Conditions in the version valid at the time the contract is concluded form part of the contract.
1.3 We sell our goods exclusively to end consumers and only in quantities customary for households.
2. Copyright and industrial property rights
2.1 The contents of this website are protected by law. It is prohibited to reproduce, distribute or use for commercial purposes any material protected by copyright, trademark or competition law — in particular texts, illustrations, graphics, software, videos, music, trademarks, logos and other company marks — without prior written consent.
2.2 Where content is made available for download by Love Joy Victory, no rights of use beyond the specific purpose of the download are granted.

3.2 Storage of the contract text: we store the contract text and send you the order data and our General Terms and Conditions by e-mail. The Terms can be viewed here at any time. For security reasons, your order data is not accessible via the internet.
4. Conclusion of contract and delivery terms
4.1 The presentation of the products in the online shop is not a legally binding offer but a non-binding online catalogue.
4.2 By clicking the “Buy now” button you place a binding order for the goods in your shopping cart, which constitutes an offer to NB Fashion GmbH.
4.3 Receipt of your order is confirmed immediately after the order has been submitted.
4.4 We may accept your order by sending an order confirmation by e-mail.
4.5 The risk of damage passes to you upon delivery of the goods, otherwise upon your default of acceptance.
5. Right of withdrawal and return of goods
5.1 Right of withdrawal
As a consumer you have a right of withdrawal of 30 days from receipt of the goods. The details are set out in our withdrawal policy, which we also send you with the order confirmation. A model withdrawal form is provided there as well. You can also declare your withdrawal directly online using our withdrawal form.
5.2 Condition of the goods
Please return the items complete, unworn, unwashed and with all labels attached. Trying items on is of course fine. For any loss of value resulting from handling beyond that, we may claim compensation and deduct it from the refund amount.
5.3 Return and return costs
Please register your return in our returns portal. You will then receive a DHL return label by e-mail. The direct cost of the return is 5.00 euros; we deduct it from the refund amount. For an exchange we provide the return label free of charge.

5.4 Refund
The refund is made via the payment method originally chosen within 14 days of receipt of your return. In the event of a full withdrawal we also refund the shipping costs of your order. If you return only part of your order, the shipping costs remain payable.
6. Payment
6.1 All prices are in euros (€) and include statutory VAT.
6.2 The available payment methods are: PayPal, instant bank transfer, credit card, Google Pay and Klarna.
6.3 Payment by credit card is only permitted if the customer is also the cardholder.
6.4 Klarna purchase on account is only available to consumers. The full terms for purchase on account are available on the Klarna website.
7. Warranty
7.1 Deviations in structure and colour are reserved insofar as they are inherent in the materials used and customary.
7.2 When asserting warranty claims, the defect must be described precisely. If a replacement delivery is desired, this must be stated explicitly.
8. Assignment
Claims against NB Fashion GmbH may not be assigned.

10. Final provisions
The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
11. Retention of title
11.1 The delivered goods remain the property of NB Fashion GmbH until payment has been made in full.
11.2 The customer is obliged to handle the goods with care for the duration of the retention of title.
11.3 The customer must notify us without delay of any change of address or of ownership of the goods.
12. Vouchers
12.1 The 15 € welcome voucher advertised on the website is valid exclusively for new customers who subscribe to the newsletter with their e-mail address for the first time.
12.2 The voucher can be redeemed only once per customer and only for the first order. It cannot be combined with other discount promotions and cannot be credited retrospectively.
12.3 Improper use of several e-mail addresses in order to use the voucher repeatedly may lead to exclusion from the voucher promotion.
12.4 We reserve the right to change the voucher conditions at any time or to end voucher promotions in whole or in part without any claims arising against us.
Consumer dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (section 36 (1) no. 1 VSBG).
